Thrifty Guadeloupe Rental Terms

TERMS AND CONDITIONS OF RENTAL

Thrifty SALVA license independant from Thrifty International (referred to as “Thrifty”, “we”, “us” or “our”)
rents the vehicle (including any replacement vehicle) to you subject to the informations and conditions
contained in these terms and conditions. By renting a Thrifty vehicle you accept the Rental Agreement terms
and conditions and confirm that you will strictly comply with them.

1. NATURE OF THIS AGREEMENT

The rights and obligations contained in Rental Agreement govern your use of our vehicle and are not
transferable by you. You acknowledge that the vehicle is owned by us and that any attempted transfer
or sub rent of the vehicle by anyone other than us is void. We permit you to use the vehicle on the
terms and conditions of the rental agreement only.

2. WHO MAY DRIVE THE VEHICLE

2.1 The vehicle must only be
driven by you or any other person who has first been authorisez by
us and added to the rental record. However, the main car driver must be both the rental paying
person and guarantee supporter except for rentals registered for account consignors. You
hereby agree to present us the original of your drivers’ license that must be valid for at least
one year with an international driving license, required for all countries except Europe Union
countries and whose driving license wouldn’t be written in roman alphabet and not allow
anyone, including yourself :
2.1.1 who does not fulfill our minimum requirements regarding age and possession of a valid
driving license as indicated for the relevant rate or otherwise notified by us ; or
2.1.2 who is over-tired or under the influence of alcohol, drugs, medication or any other legal or
illegal substance impairing their consciousness or ability to react.

3. RATE QUOTES

Vehicle rental rates and available vehicles may considerably vary depending on location and date and
they change very frequently. A rate quote you receive is merely indicative of the rates then being
offered and creates no legal rights. No guarantee regarding vehicle availability or the continued
applicability of the quoted rate can be given.

4. RESERVATIONS

A “reservation” for a vehicle rental is a notation in Thrifty’s record that you have expressed the desire
and intention to rent a vehicle of a specified class at a specified time, date and location (“pick up”
time, date and location), on the terms and conditions and subject to rental qualifications and
requirements that Thrifty imposes for such a rental. Pick up and return times for reservations are
always expressed in local time at the pick up and return locations, respectively.
Thrifty accepts reservations only for a class of vehicles and not for vehicles either of specific makes,
model years or models or with particular characteristics not common to all vehicles in a given class.
If Thrifty allows you to make a reservation, you accept any legal obligations that arise and are
indicated in detail below as well as the practical and non-legal significance of such reservation.
When you make reservation for a rental transaction, you will receive from Thrifty a quote of the
estimated total charge for the rental. Such a total will generally be computed on the basis of the
information available at the time of the reservation, without regard to charges for optional products
and services.

4.1 Prepaid Rental Transactions
When you enter into a prepaid rental transaction, you make a confirmed reservation with Thrifty to
rent a vehicle of a specified class from Thrifty at a specified pick up time, date and location, with the
vehicle to be returned at a specified return time, date and location. You also pay by debit or credit
card, soon after the reservation is made, the total rental charge quoted at the time of reservation.

4.2 Guaranteed Reservations
Rental agencies will hold your reservation for two (2) hours from the reserved pick up time. Airport
rental agencies will hold your reservation two (2) hours after the landing of the airplane (if the
information was available at the time of reservation). Two (2) hours after the time of pick up, the
reserved vehicle can be made available for rental to another customer. Should the customer arrive
after the two (2) hour period, Thrifty will attempt to provide a vehicle, but cannot guarantee
availability. An extra charge for late arrival will be applied.
As indicated in the paragraph below “Conditions outside the Control of Thrifty (Force Majeure)”, if,
as the result of events or conditions outside of our control it is impracticable for Thrifty to perform
its obligations, we can cancel the prepaid rental transaction, and in that case you will be promptly
refunded without any deduction the prepaid rental charge that had been collected from you.
Additionally, as indicated below under “General Conditions outside the Control of the Customer”, if,
as the result of general events or conditions outside your control, it is impracticable for you to
perform your obligations, the reservation will expire as soon as you give notice to Thrifty of the
existence of such event or condition and you will be promptly refunded without any deduction the
prepaid rental charge that had been collected from you. In an airport location, outside of the business
hours, we guarantee the reservation within 2 hours from the long-haul flight arrival time, and within
1 hour from a short-haul or medium-haul flight arrival time.

4.3 Specific vehicles reservations
Thrifty accepts reservations for vehicles indicated as “specific” (requiring availability request to
Thrifty Reservation Center) in prepaid rental transactions (see conditions of prepaid rental
transactions).

4.4 Conditions outside the Control of Thrifty (Force Majeure)
If it is impracticable for Thrifty to perform any of its obligations at the specified pick up time, date
and location as the result of events or conditions beyond Thrifty’s control, including, without
limitation, any governmental act, flood, fire or other natural catastrophe, unusually severe weather
(including wind, snow and ice storms), epidemic, Act of God, war, terrorist act, riot, insurrection, civil
strife, national emergency, strike or other labor dispute, utility failure, failure or disruption of data
processing or transmission or failure or disruption of access or supply, then in the case of a prepaid
reservation, the transaction will be cancelled and Thrifty will promptly refund you, without any
deduction for liquidated damages.

4.5 General conditions outside the Control of the Customer
If it is impracticable for you to perform any of your obligations described as “Prepaid Rental
Transactions” at the specific pick up time, date and location as the result of general events or
conditions beyond your control, including, without limitation, any governmental act, flood, fire or
other natural catastrophe, Act of God, war, terrorist act, riot, insurrection, civil strife, national
emergency, strike or other labor dispute, utility failure, failure or disruption of data processing or
transmission or failure or disruption of access or supply, then in the case of a prepaid reservation,
the transaction will be cancelled and Thrifty will promptly refund you, without any deduction for
liquidated damages.
You should note, however, that events and conditions that are beyond your control but that are not
general in nature, including, without limitation, the condition of your health and the health of those
traveling with you, will not excuse your performance of your obligations under a prepaid rental
transaction.
You should consider travel insurance or similar arrangements to protect you against unforeseen
events and conditions that are specific to you and those traveling with you.

4.6 No show
Thrifty reserves the right to charge a No Show Fee. No fee would be charged if the customer cancels
or modify his reservation at least one hour prior to the pick up time and date.

5. RESERVATIONS, PICK-UP, DELIVERY AND RETURN

5.1 We will supply the vehicle to you in good overall and operating condition, complete with all
necessary documents, parts and accessories.
You agree to return the vehicle to us in the same condition as you rented it, subject to fair wear and
tear, with the same documents, parts and accessories, at the location and on the date and time
designated in the Rental Agreement.

5.2 You and we will check the condition of the vehicle at the start of the rental and at the return of the
vehicle. A Thrifty representative will provide a record showing any agreed defects. You acknowledge
that you will be responsible for any loss or damage to the vehicle, its documents, parts or
accessories arising during the rental.

5.3 The vehicle must be returned to the agreed Thrifty location within the normal business hours of the
location concerned. If you return the vehicle outside of these hours you must comply with the out of
hours return instructions for that location. If you fail to comply with these instructions, you will
remain responsible for the vehicle until we are able to access it.

5.4 If at any time we have agreed that you may return the vehicle to a place other than a Thrifty rental
location, or if we have agreed to collect it, you will remain fully responsible for the vehicle until it is
collected by us.

5.5 Our rental fees are charged on a 24 hour basis starting at time of rental. Extending the duration
(hours or days) requires prior agreement by Thrifty. Your signature is required for extending the
duration of the rental contract. For failing to return the vehicle by the time agreed to at time of rental,
an extra rental day will be charged based on daily rate policy including all fees pertaining to selected
options for each full or partial late day. These charges apply unless an extended return delay (“grace
period”) is stipulated in a written mutual agreement signed prior to time of rental or in our ongoing
policy (for more information please inquire at the rental location).
We offer a 29 minute grace period.
A penalty will be charged if the vehicle is returned at a different location to the one agreed to at time
of rental.
The rate will be recalculated and a penalty will be charged for returning a vehicle prior to the return
date agreed at time of rental.
By not respecting the return date agreed to at time of rental, a police report may be filed against you
for misappropriation and breach of trust, and measures will be taken with public authorities to
recover the vehicle. Under penalty of loss of all insurance coverage, you will be fully responsible for
theft and/or damages up to the amount of the full deductible or the market value of the vehicle.

5.6 You agree that we are entitled to charge you an additional cost if the vehicle requires more than our
standard cleaning on its return to restore it to its pre rental condition allowing for fair wear and tear.

5.7 If you decide to extend your rental, you will have to go to the agency to pay current price according to the
period. Thrifty could refuse to extend location without penality for the renter and he will have to immediately
return the car.
Thrifty can decide to put end the rental before the end of the contract if you do not respect fundamental
obligations, especially car conditions of use, rental payment or car restoring conditions.

6. YOUR RESPONSIBILITY FOR LOSS OR DAMAGE

6.1 Subject only to any deductions arising from your acceptance of any options specified at paragraph
4.2 you will be liable to us for all losses and costs incurred by us in the event of loss, damage to or
theft of the vehicle, its parts or accessories while on rental. Your liability may include the cost of
repairs, loss in value of the vehicle, loss of rental income, towing and storage charges and an
administration charge, which recovers our costs for handling any claim arising from damage caused
to the vehicle unless responsibility for the damage lies with us or has been determined by a third
party or their insurers to lie with the third party. You will not be liable to us for any charge or excess
if the loss or damage is directly due to our negligence or breach of the Rental Agreement.

leaflet, which is available at the counter.

was made. It applies to the following modifications:
- Return location;

reservation.
You will have to enter a valid credit card number at the end of the modification to a prepaid reservation. The
credit card number MUST be the same that was used for the original reservation. If you wish to change the
credit card, then the original reservation must be cancelled (see below “Cancellations”) and a new
reservation made.
Discount: you can add a CDP code to a reservation, nevertheless, the CDP code being linked to a negotiated
rate, it is not compatible with prepaid rates. You may cancel your original reservation (see below
“Cancellations”) and make a new reservation adding the CDP number.

pick up date, or if you fail to comply with the pick up terms (see above), we reserve the right to make
a Cancellation/No show charge which recovers our administration costs and compensates us for our
inability to rent the vehicle when it was reserved for your use.

9.4 No Show fees: Non prepaid reservations
Should you fail to pick up the vehicle with 2 hours from the pick up time and date, or in the case of
airport rentals, within 2 hours of the flight arrival time (if a flight arrival time has been provided to

5.7 If you decide to extend your rental, you will have to go to the agency to pay current price according to the
period. Thrifty could refuse to extend location without penality for the renter and he will have to immediately
return the car.

6.2 Provided you comply with all the terms of this Rental Agreement and provided the loss, damage or

specified, your liability for loss of or damage to the vehicle, its parts or accessories other than

damage arising from a specific event, to the amount of the excess stated on the Rental Record ;
and
6.2.3 if you accept the optional super CDW (SCDW)and conditions by paying the daily charge
specified, your liability for loss of or damage to the vehicle, its parts or accessories other than
caused by theft, attempted theft or vandalism is eliminated.
If you do not accept any of the above optional coverage, you will be charged for the full excess
amount as stated on the Rental Record. These optional coverage are further summarized in our
leaflet, which is available at the counter.
6.2.4 If you accept the optional STF insurance and conditions by paying the daily charge specified,
you liability for loss or damage to vehicle, its parts or accessories other than caused by theft,

responsible for pneumatics.
This responsibility is not excluded by any waiver.

6.4 SCDW and STF are not available to customers under 25 years old or over 65 years old.

7. PROHIBITED USE OF THE VEHICLE

7.1 You are authorized to drive the vehicle on the conditions contained in this paragraph 2 and paragraph
5 above including, at all times, to use the vehicle in a responsible manner. If you do not comply with
these conditions, you will be liable to us for any liability or loss incurred by us or any damages or
reasonable expenses we suffer or incur as a result of your breach. You may additionally lose the
benefit of any waivers or insurance selected by you. We reserve the right to take back the vehicle at
any time, and at your expense, if you are in breach of this Rental Agreement.

7.2 You must look after the vehicle, make sure it is locked, secure and parked in a safe place when not
in use and set and use any security device provided. You must remove and keep in a safe place any
removable radio and/or radio faceplate when the vehicle is unoccupied. You must use seat belts,
child seats and other child restraints as appropriate.

7.3 You must use the correct fuel and check the oil and other fluid gauges beyond 1000 km for cars and
500 km for vans, refilling as necessary. If you experience any problem due to accident or mechanical
failure, you must contact us on the number indicated on the Rental Wallet. No one may service or
repair the vehicle without our prior express permission.

7.5 Thrifty vehicles are never allowed to leave the island where they were rented. Insurances, optional
protections and deductible waiving amounts are not valid beyond the borders of this territory. In case
of damage, collision or theft, you will be responsible for the vehicle’s monetary value.

8. PAYMENT OF CHARGES

8.1 We accept for payment and deposit the main credit cards, Thrifty authorized cards and means of
payment issued by Thrifty. The main car driver must be the car holder, except when rentals are made
by account consigners.

8.2 At time of pickup a mandatory safety deposit is required.
The safety deposit authorizes Thrifty to recover (including via direct debit or direct deposit) any
amounts due pertaining to the car rental, as well as to any damages or losses as defined in articles
6-7-11-12-13-14-15-17 or for fees charged for not returning the vehicle.

on invoice, we will reserve the right to apply late penalties in addition to amounts owing according
to basic interest rate interbank lending market for a period of one month, with a majoration of three
per cent.

9. PREPAID RENTAL CONDITIONS

Thrifty charges cancellation and no-show fees on all prepaid rental transactions.

9.1 Modification of reservations
All modifications concerning an online reservation or with Thrifty sale representatives will lead to a
recalculation of the rates depending on availability and the rates applied at the time of the
modification.
The adjustment can be an increase or a reduction of the rate proposed when the original reservation
was made. It applies to the following modifications:
- Return location;
- Pick up time and date;
- Return time and date;
- Class of vehicle
- Flight details (including airline and flight number)

or the pick up location, then you must cancel the reservation (see below “Cancellations”) and make a new
reservation.

9.2 Cancellations
1- Thrifty allows you to cancel a prepaid reservation
a. Online by the “Modify/Cancel” reservation page

9.3 Cancellations/No Shows: Prepaid reservations
If you fail to cancel your reservation prior to the pick up time and do not collect the vehicle on the
pick up date, or if you fail to comply with the pick up terms (see above), we reserve the right to make
a Cancellation/No show charge which recovers our administration costs and compensates us for our
inability to rent the vehicle when it was reserved for your use.

9.4 No Show fees: Non prepaid reservations
Should you fail to pick up the vehicle with 2 hours from the pick up time and date, or in the case of
airport rentals, within 2 hours of the flight arrival time (if a flight arrival time has been provided to
Thrifty), Thrifty reserves the right to charge a No Show fee. The fee will be to compensate Thrifty for
loss of revenue and costs incurred in reserving and preparing a vehicle.

10. DISCOUNT AN RATES

than a full tank of fuel, a refuelling service charge will be owed by you for fuel and the service of
refuelling at the applicable rate (specified on the Rental Agreement.).
If you do not give back vehicle with same level of fuel as at the beginning of rental, Thrifty will apply
fuel service fees and you will also have to pay the fuel missing according to fuel price per liter.
Regarding rentals with less than 50 kilometers on odometer, you will have to present a document
certifying refueling service, otherwise Thrifty will evaluate fuel used by multiplying distance covered
according to car category and fuel price index. [index= (number of liters/100km X miles driven X fuel
price per liter).

13. RESPONSIBILITY FOR PROPERTY

13.1 We are not liable to you or any authorized driver or passenger for loss of or damage to property left

discovery of the incident. You must report any such incidents to us within 5 days of its discovery.

disclaimer in the event of an accident, but should take the names and addresses of everyone
involved, including witnesses.

15.3 An accident or theft report form must always be completed and submitted to us when you return the
vehicle. In the event of theft, you must return the keys and any remote control anti-theft device to us.
If you do not comply with the requirements of this paragraph 15, any optional coverage you take to
reduce or eliminate your liability, such as CDW or STF or TP (in case of theft) will be void.

arising out of any loss of or damage to the vehicle.
